Evidence

On August 25, 2020, the CNMP decided not to open disciplinary proceedings against Dallagnol over the PowerPoint (a request for measures by Lula's defense) because the applicable penalty was time-barred (the earlier warning had its effects suspended by a Fux decision on August 17, 2020, according to Gazeta do Povo); according to Conjur, the rapporteur was Marcelo Weitzel and there were 42 postponements (Brasil de Fato mentions 40).

Folha de Pernambuco reports that, in the PowerPoint case, 8 of 10 council members saw grounds for disciplinary proceedings, but none was opened because of the statute of limitations.

On September 10, 2019 the CNMP rejected, by 12 votes to 0, Renan Calheiros's request to preventively remove Dallagnol while a disciplinary proceeding on the tweets was under way; the opening of the PAD was postponed by a request for review of the file; Internal Affairs Commissioner Orlando Rochadel considered only a breach of decorum (censure) to be established, which does not allow removal.

On August 17, 2020 Justice Celso de Mello (STF) suspended the processing of two proceedings at the CNMP, a disciplinary one by Renan Calheiros and a request for the removal of Kátia Abreu, both seeking Dallagnol's departure from the coordination of the task force; the AGU asked for review of the decision, warning that the disciplinary proceeding would be time-barred on September 10, 2020.

Gazeta do Povo recorded, on August 17, 2020, that three cases were on the CNMP agenda for August 18: a request by Lula's defense (PowerPoint), Renan Calheiros's PAD, and a request for compulsory removal in the public interest of Kátia Abreu, the latter with the potential to remove Dallagnol from Lava Jato.

On September 22, 2020 the CNMP unanimously opened a PAD against prosecutor Diogo Castor de Mattos, a former member of the task force, for contracting a billboard in tribute to Lava Jato (violation of impersonality, according to Internal Affairs Commissioner Rinaldo Reis Lima); Dallagnol is cited in the report only as former coordinator, and not as a defendant in this PAD.

On November 28, 2017 the CNMP unanimously denied an appeal by federal deputies Paulo Pimenta and Wadih Nemer (spelling on the CNMP page) against the closing of a complaint about Dallagnol's lectures, finding that lectures fall within the teaching permitted to members of the public prosecutor's office, that he did not deal with confidential matters, and that most of the money went to philanthropy.

On June 27, 2019 National Internal Affairs Commissioner Orlando Rochadel closed the inquiry against Dallagnol and Roberson Pozzobon about the content of the leaked messages, for lack of evidence and on the understanding that, even if they existed, the messages would have been obtained unlawfully and would not show professional misconduct.
