On May 16, 2023, the TSE decided unanimously, with Benedito Gonçalves as rapporteur, to revoke Dallagnol's candidacy registration (elected federal deputy for Podemos in 2022), finding that he had asked to resign from the MPF to avoid an administrative penalty by the CNMP that would have made him ineligible, in fraud of the Clean Record Law (Lei da Ficha Limpa); the Chamber of Deputies confirmed the loss of his seat on June 6, 2023.

In 2026 he was elected senator for Paraná for Novo (number 300), with 2,904,594 votes. On October 3 the rapporteur at the TSE found that he remains ineligible in 2026 and denied the registration; the next day the president of the TSE reinstated the candidacy.
