On May 16, 2023, the TSE decided unanimously, with Benedito Gonçalves as rapporteur, to revoke Dallagnol's candidacy registration (elected federal deputy for Podemos in 2022), finding that he had asked to resign from the MPF to avoid an administrative penalty by the CNMP that would have made him ineligible, in fraud of the Clean Record Law (Lei da Ficha Limpa); the Chamber of Deputies confirmed the loss of his seat on June 6, 2023.

On March 31, 2022, Moro announced that he was giving up his presidential pre-candidacy to join União Brasil, at the invitation of Luciano Bivar, and the president of Podemos said she learned of his departure from the press.
