Paraná Regional Electoral Court (TRE-PR)

On April 9, 2024, the TRE-PR rejected, by 5 votes to 2, the actions by the PL and by the PT/PCdoB/PV federation that sought revocation of Moro's term for abuse of economic power, off-the-books campaign funds (caixa 2), and improper use of the media in the 2022 campaign (electoral).

According to Poder360, the rapporteur pointed to 15 proceedings that could have become administrative disciplinary proceedings (PADs) and found that the early resignation defrauded the rule; the TRE-PR had granted the registration on October 19, 2022 because no PAD had been opened; Marlon Reis considered the analysis precise; Marco Aurélio Mello said that fraud is not presumed and that the decision might target protagonists of Lava Jato.

On October 3, 2026, Floriano Marques denied Dallagnol's registration in a single-judge ruling, finding that the 2021 resignation was a maneuver to avoid ineligibility, that the eight-year ineligibility covers 2026 (Jovem Pan does not state the period or the dates) and that no new facts had emerged; he reversed the TRE-PR, which had granted the registration on the grounds that the disciplinary proceedings had been closed.

On May 21, 2024, the TSE, unanimously and with Floriano de Azevedo Marques as rapporteur, rejected the appeals of the PL and the Federação Brasil da Esperança and upheld the TRE-PR decision (5 to 2, of April 9, 2024) that had dismissed the actions alleging undeclared campaign funds (caixa 2), abuse of economic power, misuse of media outlets and irregularities in contracts; the rapporteur required 'robust proof', calculated the spending at 17% of the cap and said the conduct was not an ethical model but did not prove excess; Moro kept his Senate seat.

On October 3, 2026, the TSE rapporteur, Justice Floriano de Azevedo Marques, suspended Deltan Dallagnol's candidacy for the Senate in Paraná, reversing a TRE-PR decision that had authorized it; the decision will be submitted to the full court.
