Per diems and airfare for the task force and the Federal Court of Accounts (TCU) special accounts proceeding
Deltan Dallagnol · Rodrigo Janot · Bruno Dantas · Humberto Martins
The Federal Court of Accounts (TCU) examined the payment of per diems and airfare to prosecutors assigned from other locations to the Curitiba task force. On August 9, 2022 the Second Chamber ordered, 4 to 0, Dallagnol, Janot, and João Vicente Beraldo Romão to reimburse R$2,831,808 to the Union, with a R$200 thousand fine. It is a conviction by an audit court (court of accounts). Romão was cleared on appeal. On December 5, 2022 the Federal Court in Curitiba annulled the TCU decision as to Dallagnol, and the Federal Regional Court of the 4th Region (TRF4) upheld the annulment (report of September 26, 2024); at the same time the Superior Court of Justice (STJ), in a request to suspend an injunction, authorized the resumption of the special accounts proceeding (2022, 2023, and August 2025).

In an article of September 26, 2024 (session date not provided), the TRF-4 Twelfth Panel denied the Union's appeal and upheld the first-instance judgment (case 5033048-90.2022.4.04.7000) that had annulled the decision of the TCU Second Chamber, for lack of legal basis for Dallagnol's summons; the report says responsibility for the per diem model lay with other officials.

- Accusation
- Bruno Dantas: The rapporteur at the Federal Court of Accounts (TCU), Bruno Dantas, pointed to a lack of grounds for the per diem model and violation of economy and impersonality, calling the expenses uneconomical, unlawful, and illegitimate acts that may amount to willful acts of improbity.

Limitations: The STJ decision was issued in a request to suspend an injunction (it did not examine the merits of the accounts proceeding); the report describes it as upholding the TCU's conviction, which conflicts with the court annulment of December 5, 2022 and with the nature of the SLS, and for that reason is not adopted here.
