Dallagnol's PowerPoint and the civil judgment for moral damages to Lula

Deltan Dallagnol · Lula · Luis Felipe Salomão · Cármen Lúcia

At a press conference in September 2016 (the 14th, according to InfoMoney of September 15, 2016), Dallagnol presented PowerPoint slides in explaining the triplex indictment against Lula. Lula went to civil court and asked for R$1 million in moral damages; the ordinary courts ruled against him. On March 22, 2022 the Fourth Panel of the Superior Court of Justice (STJ), by majority, ordered Dallagnol, personally, to pay R$75 thousand; the motions for clarification were rejected unanimously (news of August 10, 2022), and the Supreme Federal Court (STF) declined to hear the extraordinary appeal in 2024. According to a report, in November 2025 Dallagnol deposited R$146,847.13, an amount financed, he said, by donations. It is a civil judgment (damages), not criminal. In 2020 the National Council of the Public Prosecutor's Office (CNMP) did not punish the episode in the disciplinary sphere because of the statute of limitations.

Status as of October 24, 2026: Civil judgment upheld by the STF in 2024; res judicata (final and unappealable status) not confirmed. According to a report dated December 19, 2025 (single source), Dallagnol deposited R$146,847.13 on November 27, 2025 (an amount set at R$135.4 thousand by the TJ-SP in July 2025, plus attorney's fees), stating in a video, according to the report, that he had covered the payment with donations from more than 12 thousand people (about R$835 thousand) and had given the surplus (about R$688 thousand) to philanthropic hospitals. We did not locate a certificate of res judicata or an accounting of the funds raised.

Response
Deltan Dallagnol: In the motions for clarification, Dallagnol and the ANPR argued that Dallagnol lacked standing as a defendant, since he acted as a member of the Public Prosecutor's Office; Dallagnol said, after the payment, according to the report, that he would give the PowerPoint again and did not regret it.

In a news item of August 10, 2022 (session date not provided), the Fourth Panel unanimously rejected the motions for clarification filed by Dallagnol, by Lula (who wanted a larger amount) and by the ANPR (which argued lack of standing to be sued), maintaining the judgment.

The STJ found that Dallagnol acted with abuse of right by using non-technical language ('petrolão', 'propinocracia') and descriptions such as 'supreme commander of the corruption scheme', attributing to Lula facts that were not in the indictment; it set a base amount of R$50,000 (two-phase method), raised in the second phase to R$75,000.
