AccusationProven in a document

Conjur lists, among the grounds of the majority: the 'spectacularized' forced appearance of Lula for questioning, interceptions considered illegal and hasty, the release of the conversations, the maintenance of the arrest after a habeas corpus, and the content of the conviction.

On March 22, 2022, the STJ Fourth Panel, by majority, in REsp 1.842.613, ordered Deltan Dallagnol to pay R$75,000 in compensation for moral damages to Lula over the 2016 'PowerPoint' press conference, plus 20% in attorney's fees and costs; Lula had asked for R$1 million, and the lower courts had dismissed the claim.

Judicial or administrative decisionProven in a document

The STJ found that Dallagnol acted with abuse of right by using non-technical language ('petrolão', 'propinocracia') and descriptions such as 'supreme commander of the corruption scheme', attributing to Lula facts that were not in the indictment; it set a base amount of R$50,000 (two-phase method), raised in the second phase to R$75,000.

Lula's defense argued, with messages among prosecutors, that Lava Jato acted with the support of foreign agencies (FBI, Swiss Public Prosecutor's Office) outside official channels, asked the US for help in the 'Odebrecht case', and obtained outside official channels information to break the tax secrecy of Lula's relatives; it also stated that the material had been concealed.

On February 9, 2021, the STF Second Panel, by majority (Lewandowski, rapporteur, Nunes Marques, Cármen Lúcia and Gilmar Mendes; Fachin dissented), declined to admit the appeal by the Lava Jato prosecutors and maintained Lula's access to the Operation Spoofing messages that concern him; the majority said the judgment did not address the validity of the evidence, only access to elements held by the State.
